Lukoil, Bashneft Form JV to Develop Trebs, Titov Oil Fields

OAO LUKOIL President Vagit Alekperov and OAO ANK Bashneft President Alexander Korsik signed agreements in LUKOIL's Central Offices in Moscow Tuesday.

Under one of the agreements, LUKOIL acquires a 25.1% share in OOO Bashneft-Polus who holds the license for Roman Trebs and Anatoly Titov oil fields. The other document signed is a joint venture partner agreement.

The amount of the transaction is $151 million (4.768 billion rubles).

At the same time, Bashneft-Polus signed an agreement to purchase 29 exploration wells at the aforesaid fields from OOO LUKOIL-Komi for USD $60 million.

Bashneft and LUKOIL, having completed the establishment of the joint venture to develop R. Trebs and A. Titov oil fields, proceed to active deployment of the project.

The OOO Bashneft-Polus partner agreement concluded under the Russian law establishes, without limitation, the managerial rights of the parties, their liabilities as regards the financing of the JV proportional to their stakes and also the JV planning and operation procedures, including the use of the parties' technologies, infrastructure facilities and product-sale policies in compliance with the license.

The partner agreement regulates transportation under market conditions: oil from R. Trebs and A. Titov fields will be transferred to oil tankers at LUKOIL's Varandey loading terminal in the Barents Sea. The agreement also provides for potential delivery of associated petroleum gas to the energy centre of the Yuzhnoye Khylchuyu field, developed by OOO Naryanmarneftegaz (a joint venture of OAO LUKOIL and ConocoPhillips), to generate power for production processes at R. Trebs and A. Titov fields.

The Board of Directors of the joint venture consists of 8 members, 6 of whom shall be nominated by Bashneft, 2 by LUKOIL. According to the partner agreement, while OAO ANK Bashneft shall hold the exclusive right to nominate general director of the joint venture for the approval by Bashneft-Polus Board of Directors, OAO LUKOIL shall, also exclusively, nominate deputy financial and economy general director, subject to approval by the venture's Board of Directors.

"Joint efforts of the oilmen of the two companies will undoubtedly result in successful development of the Trebs and Titov fields, ensuring ramp-up of hydrocarbons production in Russia's strategic region of Timan-Pechora. We are pleased to see that the infrastructure LUKOIL has built in the adverse terrains will redound to the advantage of the partners", Vagit Alekperov commented.

"We are pleased to express content with the constructive cooperation with LUKOIL on the development of Trebs and Titov fields, which will serve as a foothold for the company's growth in the midterm. I am sure that the expertise of our teams, innovations and mutual understanding between the parties will be a guarantee of the project's success", Alexander Korsik added.

In February of 2011, ANK Bashneft obtained a license for a federal-level site of subsurface resources, including R.Trebs and A.Titov oil fields, for a term of 25 years.

April 15, 2011, Bashneft and LUKOIL signed an agreement to establish a joint venture to develop the fields. December 14, 2011, the license was reissued to Bashneft-Polus.

The 830.5 square miles (2,151 squarekilometers) license area is located in the Nenets Autonomous District. The total recoverable oil reserves of commercial categories ( 1+ 2) located within the license areas of R.Trebs and A.Titov fields, as booked in the state balance sheet, reach 140.1 million tons.

[uruknet.info] 32 Palestinians left homeless by Israel in December

A Palestinian home after demolition in the Jordan Valley in the West Bank (photo: flickr/PSP Photos)

December 26, 2011

The first three weeks of December saw Israel demolish over 20 structures, leaving 32 Palestinians homeless and affecting another 150 people. In addition, several places have received new stop-work or demolition orders and verbal warnings from Israeli forces.

Demolitions:

22 December

-??????????Az-Zaayyem,?Jerusalem Area C: A demolition team arrived in az-Zaayyem, a community that had suffered a demolition of all its residential and animal shelters on 29 November, presumably to demolish assistance so far and the three structures unharmed in the previous demolition (pigeon cage, reception tent and a food storage structure). The community was able to how the team an injunction and?no structures were demolished. The demolition team verbally informed the community that steps would be undertaken to decide on the continued validity of the injunction. During these events, several community members sustained minor injuries and three people were temporarily detained on-site.

-??????????Al-'Isawiya: The Israel Nature and Park Authority uprooted trees and leveled land in al-'Isawiya, also in the area that is part of the proposed plan for a national park.

-??????????Idhna,?Hebron: Several water structures and agricultural structures were demolished, details are still being verified

-??????????Al-Majnouna (ad-Dura),?Hebron: Several greenhouses and at least one cistern were demolished.

-??????????Nablus governorate: Two roads connecting?Huwwara, Beita and Zatara?were demolished, affecting access for some 6,000 people.

21 December

-??????????Kufr ad-Deek, Salfit: Three wells for agricultural use were demolished as well as three agricultural structures. This demolition affected 15 families, approximately 75 people.

20 December

-??????????Fasayil al-Wusta,?Jericho: Seven residential shelters (three uninhabited), three kitchens and six animal shelters were demolished in Fasayil al-Wusta. This displaced at least 32 people and affected 30 more. The same community had suffered a demolition on 14 June, when 100 people were displaced. Emergency residential shelter has been provided and other needs have been assessed. It is worth mentioning that the area is included in a planning exercise, the results of which have been submitted to the Israeli Civil Administration recently.

-??????????Fasayil al-Fauqa,?Jericho: Two animal barracks were demolished, affecting nine people. Its the third demolition of the familys animal shed in this location. Two women were injured by the demolition team when they tried to retrieve belongings from the shelter.

-??????????As-Suwwana, East Jerusalem: The playground of the?Ibrahimi School was leveled by the Israel Nature and Parks Authority. The area leveled would be part of the proposed plan for a national park in the?MountScopus area which would hinder the development of the Palestinian neighborhoods of al-'Isawiya and at-Tur.

-??????????At-Tur,?East Jerusalem: One large animal shelter was demolished by the Israeli Israel Nature and Parks Authority affecting three people.

-??????????Beit Safafa, East Jerusalem: Two animal shelters were demolished by the?Jerusalem Municipality, affecting 26 people.

13 December

-??????????Al-Makhrour, Beit Jala?Bethlehem:? Three seasonal lodgings used for agricultural purposes were demolished, affecting at least 18 people. The community mentioned that the houses were built at least 100 years ago by the land owners. The structures had undergone recent rehabilitation. Two of the families noted that they did not receive stop-work or demolition orders. However, the Israeli Civil Administration noted that orders had been delivered.? The one family that confirmed receiving a written order was not aware of the needed legal procedures and did not take legal action. The family is also expected to pay for the cost of the demolition. The area is in close proximity of the Har Gilo settlement.

Demolition orders:

-??????????Susiya,?Hebron: The petition deadline for the demolition order against certain parts of the school in Susiya was today, 22 December.

-??????????Al-Aqaba, Tubas: On 19 December Israeli forces handed over seven stop-work orders for seven structures - three residential structures under construction and four agricultural structures. The deadline for objections is 5 January 2012. Two of the affected families have previously suffered demolitions. The orders affect five families, some 30 people. Legal follow-up is being provided. It is important to note that the community of al-Aqaba has submitted several proposals for a master plan to the Israeli Civil Administration and is now awaiting a response to the third version. Several?ICA representatives, including reportedly the Head of the Israeli Civil Administration, have recently visited the community, also to discuss the situation of the village and the greater?Jordan Valley with the Village Council.

-??????????Wadi Maleh: A Civil Admin officer delivered 6 (separate) demolition orders for all structures in the community on 19 December. The officer had noted that the community should remove the structures and leave the area before 5 January 2012 or they will face demolition. There have been two demolitions in the community in the last two months (06 October and 30 November).

-??????????Arab Ramadin Ash Shamali: On 15 December two stop-work orders were delivered (for one residential shelter and one animal barracks). One of these structures was demolished on 11 October and rebuilt afterwards. Legal follow-up is being provided; the deadline for objections also is 5 January. The recipient of the assistance following the October demolition reports receiving regular visits from the Israeli Civil Administration

-??????????Arab Ramadin Al-Janubi: On 14 December the Israeli Civil Administration issued verbal warnings on structures belonging to a family of seven and noted that a team would return soon to demolish structures in the community. An order was issued about one year ago.

Could a compound in fish oil cure leukemia?

A compound produced from EPA -- Eicosapentaenoic Acid -- an Omega-3 fatty acid found in fish oils may help cure chronic myelogenous leukemia, or CML. In their study, Penn State researchers found the compound delta-12-protaglandin J3, or D12-PGJ3 honed in on and killed CML stem cells in mice.

Targeting stem cells as a cure for chronic myelogenous leukemia, which is one of four main types of blood and bone marrow cancer, is important because stem cells can divide to create more stem cells that in turn spread cancer.

Sandeep Prabhu, associate professor of immunology and molecular toxicology in the Department of Veterinary and Medical Sciences at Penn State said, "Research in the past on fatty acids has shown the health benefits of fatty acids on cardiovascular system and brain development, particularly in infants, but we have shown that some metabolites of Omega-3 have the ability to selectively kill the leukemia-causing stem cells in mice. The important thing is that the mice were completely cured of leukemia with no relapse."

Robert Paulson, associate professor of veterinary and biomedical sciences, who co-directed the research with professor Prabhu, explains drugs taken for leukemia don?t cure the disease, but instead suppress the number of leukemia cells. Eventually, patients develop resistance to the drugs, which must be taken continuously.

According to the National Institutes of Health, the only known cure to date for CML is a bone marrow or stem cell transplant.

Symptoms of leukemia include easy bruising, petechial rash, enlarged spleen that manifests as pressure or a feeling of fullness under the left rib cage, low grade fever, weakness and fatigue and excessive sweating.

The disease has three stages ? chronic, accelerated and blast crisis. In the chronic phase, there are few symptoms. When leukemia accelerates, fever and other symptoms occur. During the blast crisis phase ? the most dangerous - that can occur if CML is left untreated, bleeding and infection can occur.

In the study, mice given approximately 600 nanograms of the fish oil compound D12-PGJ3 daily, for a week, were completely cured of the disease. They did not experience relapse and spleen size and blood counts returned to normal.

The researchers used the fish oil compound because it had few side effects. The next step is to see if the blast crisis stage of chronic myelogenous leukemia will respond to D12-PGJ3. The finding means there may be a cure for leukemia on the horizon, thanks to fish oil. The researchers are planning on testing the compound in humans.

Company sues credit union manager for embezzling funds by opening fake loan

A former credit union employee is being sued after he embezzled more than $200,000 by opening fake auto loans in the names of credit union members.

Cumis Insurance Society on Friday filed a lawsuit against Javier Herrera, who worked as the West Valley City branch manager for Utah Central Credit Union from May 2008 until May 2010. Beginning in August 2008, the lawsuit alleges, he opened loans under members? names without their consent and then pocketed the money. When the scheme was discovered, and about $235,000 was missing, the man was terminated and the credit union made a claim on its insurance for protecting money lost due to employee dishonesty.

Cumis paid the credit union about $220,000 ? the total sum minus the deductible and interest potentially earned on the loans ? and then sued Herrera for the money.

The insurance company is asking for the money, and "punitive and exemplary" damages to be determined at trial and attorneys fees. The company is also asking that Herrera not be able to get rid of or sell any assets, and that a trust be created for all of Herrera?s single and joint accounts and property.

iOS 5, Ice Cream Sandwich and Windows Phone 7.5 Mango: Which is the Best OS?

It is a tough ask to compare two very different but established mobile operating systems - Apple's iOS 5 and Android 4.0 (Ice Cream Sandwich) - with the new Windows Phone 7.5 Mango.

iOS, the first mobile operating system, was launched on Oct. 12, 2000.?It was then known as the iPhone OS, named as it was after Apple's flagship smartphone series. A year later, the Android OS made its debut, with the launch of HTC Dream (T-Mobile G1). Windows was a later entrant to the sphere.

In any case, it appears the stage is now set for a battle among these three. Google's Android has been given more firepower with the acquisition of Motorola handsets. Microsoft finds solace in a promising collaboration with Nokia and Apple.

Like us on Facebook

Each of these platforms has its own strength and weaknesses, which are discussed below:

iOS 5 vs WP7 Mango vs Android 4.0

  • When it comes to apps, the iOS rules the market with a massive archive of more than?500,000 apps, including custom-built games, software and media and music. It is closely followed by Google's Android Market, with more than 250,000 apps, while Windows Mango has the weakest app support with just about 30,000 apps.
  • The iOS 5 comes preloaded with an inbuilt music player (iTunes), a custom browser (Safari) and a stock productivity suite (iWork). While, the Android 4.0 lacks a pre-loaded music player, it does include a custom browser, Google Chrome, and a stock productivity suite - Google Docs. Windows Mango, on the other hand, offers Zune - a music player, a custom browser - IE9 and a stock productivity suite - Office Mobile.
  • Apple's iOS 5 added Twitter integration to its software but does not support Flash. On the other hand, both Ice Cream Sandwich and Windows Mango support Flash alongside Twitter.
  • Android misses out on Wi-Fi Sync support, something that both the iOS 5 and Windows Mango have native support for.
  • Fortunately for hard-core gamers, all three platforms support hardware acceleration.
  • The iOS 5 has carrier support limited only to AT&T, Verizon and Sprint. Meanwhile, both Windows Mango and the Android upgrade extend support to all major U.S. carriers.
  • The iOS 5 incorporates "Pseudo-multitasking" wherein only one application window is active at a time; the others run in the background. On the other hand, both Windows Mango and Ice Cream Sandwich enjoy the privilege of real-time multitasking capability.
  • Finally, iOS 5 and Windows Mango include robust integrated security features and hence no third-party security is necessary. But their Android counterpart is vulnerable to security exploits and malware attack, and third-party security is a must.
  • Apple's software is limited to icon-centric home screens, whereas both Windows Mango and Ice Cream Sandwich extend support to widgets besides icons.
  • Both the iOS 5 and the Android 4.0 include platform support for tablets, while Windows Mango misses out on this key feature.
  • The iOS 5 supports limited customization options after jailbreaking the device. Windows Mango offers barely any such support. On the other hand, the Android counterpart supports a much richer range of possibilities.
  • Over-the-air updates and screenshot functions are limited to the iOS 5 and Android 4.0, while Windows Mango loses out.
  • In addition, both the iOS 5 and Google's Android support their native e-book stores, namely iBooks and GoogleBooks; Windows Mango misses out on this.
  • iOS 5 supports a wireless Cloud Backup with up to 5GB free storage. The other two platforms just don't qualify.

Apple's iOS 5 has been designed and revamped to offer maximum feature support for users while keeping?customization to a minimum, although this is expected to come at the expense of reliability and performance.

Google's Android upgrade aims at delivering superior performance, complete customization capabilities and regular updates to users' feature requirements.

The decision of choosing one over the other - revolving as it does around questions of balance between features, usability and performance - is that of the final user.

God Forbid that Jimmy Carter Sent Condolences to Kim Jong Un (ContributorNetwork)

COMMENTARY | Former President Jimmy Carter has allegedly sent condolences to the new dictator of North Korea, Kim Jong Un, over his loss, and wished him "every success" in the new role, which the Korean Central News Agency (KCNA) reported, according to Business Insider Dec. 21. The Washington Times reported that a Carter Center spokeswoman won't be around until next year to verify or deny the story for the newspaper as of Dec 21.

Let's hope Carter didn't. For if he did, God forbid, it will make the former president look not only foolish in general, but even more foolish to the right wing in this country, who constantly trashes his presidency and/or mentions him along with President Barack Obama, like Rep. Michele Bachmann, R-Minn., did Dec. 20, on the Fox News show "On the Record," according to Fox News' website.

When a cruel despot (e.g., Kim Jong Il, Adolf Hitler, Joseph Stalin, Saddam Hussein, etc.) dies, who in their right frame of mind thinks about going to their local Hallmark store to buy a card and/or send out some other communicative message of condolences and well wishes to those deceased's survivors?

Certainly, a high-profile former politician in the United States should not incite North Korea with "glad he's dead" rhetoric during the nation's time of grieving, which is lasting 13 days, according to the Arirang. It's wise to say nothing and keep the condolences cards in the drawer.

And what kind of political leader who values freedom would make wishes of "every success" to Kim Jong Un? What does that exactly mean? That this new strongman keep up his father's deeds of brainwashing, oppressing, and starving his people out of existence? Up to a million people died from a major famine that occurred over 10 years ago and the country is facing more famine, The Telegraph reported last summer.

Even the Obama Administration hasn't offered any public condolences to North Korea. For according to the Voice of America, the White House was focused on words about fostering stability in the Korean peninsula in the reaction rather than sending condolences or well wishes.

Anyone who would send condolences for one of the vilest human beings who's ever slithered along this earth should really think twice about that.

Say it isn't so, President Carter.

Summary Box: Italy gov't wins confidence vote (AP)

CUTS GO THROUGH: Italian Premier Mario Monti easily won a vote of confidence in the Senate on Thursday, signaling parliamentary approval of the government's euro30 billion ($39 billion) package of tax hikes and pension changes.

WHY IT MATTERS: The austerity package is intended to save the country from financial disaster. Investors have grown concerned that Italy will have trouble paying down its euro1.9 trillion ($2.5 trillion) debt load.

PROTESTS: One of the most disputed reforms is that of Italy's generous pension system. Italians will have to work longer. Unions staged strikes and demonstrations last week to protest the measures.

AP Source: Rose agrees to extension with Bulls (AP)

CHICAGO ? It seemed like something out of a movie script the moment the Chicago Bulls took Derrick Rose with the No. 1 pick in the draft.

The latest twist? A maximum contract extension.

That's just another milestone in a rapid and steady rise for the point guard from the city's South Side to stardom with his hometown team.

The reigning NBA MVP agreed to a five-year contract extension with the Chicago Bulls worth approximately $94 million, a person familiar with the situation said.

The Chicago Tribune, citing anonymous sources, first reported the deal.

The person spoke to the Associated Press on the condition of anonymity Tuesday night because the deal had not been finalized. The extension will start in the 2012-13 season, when Rose is eligible to make about $16 million. The Bulls scheduled a news conference for Wednesday, though they won't say what it is for.

"It's something big, but I think I want to talk more about it (Wednesday), with my family and everybody being there," the star point guard said after the Bulls' preseason victory over Indiana on Tuesday night. "But it's definitely something big."

And, teammates say, it was well-earned.

"We're all very excited for him," Carlos Boozer said. "He deserves it. He puts in a lot of effort. I wish the contract was for 10 years."

The chance to join Rose in the backcourt was a big draw for Richard Hamilton. The veteran shooting guard signed with the Bulls last week after being bought out by the Detroit Pistons, and so far, he likes what he sees.

"He works hard," Hamilton said. "He's young. He's 23 years old and the way he plays on the floor is the way he practices. In order to be great in this league, you just can't turn it on (during) games. He really has a great work ethic."

The deal is more of a formality than a surprise. Rose and general manager Gar Forman had indicated it would get done, and it was not hard to see why they wanted to stay together.

The Chicago product went from Rookie of the Year to All-Star to MVP in his first three seasons, becoming the youngest player to win that award. About the only thing he doesn't have is a championship ring, and that's what weighs on him as he enters his fourth season ? not the money.

"I think I live a humble life," Rose said. "Of course, I know I'll be able to afford whatever I want, but other than that, there aren't too many things that excite me. Me winning is one of the things. Me being around my family, that's another. Money, that's the last thing I think about."

The Bulls came close to winning it all last season, winning a league-high 62 games and advancing all the way to the Eastern Conference finals before losing to the Miami Heat.

Now, they're looking for more.

Rose has repeatedly pointed the finger at himself for the Bulls coming up short against the Heat in the playoffs. He worked on his inside game in the offseason after expanding his shooting range in previous years, but it's hard to imagine him accomplishing much more than he did last season.

Rose delivered one of the best seasons by a point guard. He also joined Michael Jordan as the only Bulls players to win the MVP award.

The South Side product established himself as one of the league's best players, averaging 25 points and 7.7 assists while leading Chicago to its best season since the championship era with Jordan and Scottie Pippen.

For Rose, the contract extension is just another milestone in a rapid rise from the city's rough Englewood neighborhood to a starring role with the Bulls.

He helped Simeon Career Academy become the first Chicago Public League team to win back-to-back state championships, then led Memphis to the NCAA championship game before the Bulls drafted him with the No. 1 pick in 2008 after defying long odds to win the lottery.

"The Bulls are loyal," Rose said. "They've stayed loyal with me, showed that they trusted me by picking me to come here. I just feel blessed, and I'm just happy that I'm here."

Peru's Humala slips in poll after mining conflicts (Reuters)

LIMA (Reuters) ? Peruvian President Ollanta Humala's approval rating fell for the third straight month in December to 47 percent after fierce protests against a mining project sparked his government's first crisis, pollster Ipsos Apoyo said on Sunday.

Humala, a leftist former military officer who has governed from the center since taking office in July, campaigned on promises to fight corruption, attract investment and spread the wealth from the country's decade-long economic boom.

He is struggling, however, to govern as a moderate who can keep big business happy and help poor voters eager for change.

Humala's political honeymoon has also been cut short by the anti-mining protests and an illegal lobbying scandal involving one of his two vice presidents, Omar Chehade.

Despite falling 9 percentage points in December, the latest Ipsos survey showed the president's approval rating still outweighed his rejection rating of 42 percent.

Humala, who reshuffled his cabinet last week, had an approval rating of 65 percent in September, 62 percent in October and 56 percent in November.

The cabinet shake-up followed three weeks of protests in the northern Cajamarca region, where residents and local authorities are fighting a $4.8 billion gold and copper project led by U.S.-based Newmont Mining Corp.

"While most people think the ministerial changes were necessary and approve of the new cabinet, president Humala hasn't emerged unscathed from the crisis," Ipsos Apoyo director Alfredo Toreros told El Comercio newspaper, which published the new poll.

In a bid to quell the protests in Cajamarca, Humala declared a state of emergency in the region, a measure that was supported by 73 percent of the poll's respondents.

The opinion survey polled 1,200 in cities nationwide from December 14-16. It has a margin of error of 2.8 percentage points.

SHERWIN-WILLIAMS AUTOMOTIVE FINISHES DONATES $12000 ...

December 16th, 2011?????? No Comments???

Hoffman Estates, IL ? November 16, 2011 ? Sherwin Williams Automotive Finishes has come to the aid of three school collision programs by donating $12,000 in product through the Collision Repair Education Foundation. Applied Technology Center (Rock Hill, SC), Freedom High School (Freedom, WI) and Sarasota County Technical Center (Sarasota, FL) all applied for the 2011 Ultimate Collision Education Makeover $50,000 school grant and within their wish lists, specifically requested Sherwin-Williams? products. The Collision Repair Education Foundation forwarded these requests to The Sherwin-Williams Company for consideration of donation and they have come through for the schools.

Freedom High School Technology Education Instructor Jay Abitz said, ?Sherwin-Williams has fulfilled a large need for my school. Their generous donations have taken a huge burden off of my shoulders and my budget. In these difficult economic times, educational budgets have shrunk, but thanks to Sherwin-Williams Automotive Finishes and the Collision Repair Education Foundation we have been able to keep high quality, current products in the hands of my students. I cannot thank them enough!?

Applied Technology Center and 2011 Makeover school grant winning instructor Mark Dellinger said, ?This donation is huge! With a shrinking budget that is tightening everyday, it is next to impossible to let my students just blow through waterborne basecoat. Along with quality comes money. This is a quality waterborne line that all students need to be exposed to on a regular basis. Ready or not, water is coming. This will definitely help us to be ready. All of my students are already excited about waterborne, whereas; some painters now fear it. Let?s change the mindset early.?

Sarasota County Technical Center Program Manager (Industrial Programs) Kristey Richardson said, ?Sherwin Williams is an active and valued partner to our Sarasota (SCTI) Automotive Collision Repair and Refinishing Program. Without Sherwin Williams? involvement on our program advisory committee and occasional donation of product we would not have the program success we enjoy at this time.?

Sherwin-Williams Automotive Finishes Director of Training Operations Rod Habel said, ?It is always a pleasure to work with the Collision Repair Education Foundation and its team of dedicated members to bring materials and knowledge to the schools interested in improving their programs. We at Sherwin-Williams Automotive Finishes are always willing to help toward the development of new and well educated people for our industry and working with the Education Foundation helps everyone in the industry benefit from this working relationship.?

Motorola MotoActv

Marathon runners value their data, whether they call them "data" or not. They store maps, perhaps only mentally, but often also on websites like MapMyRun or with apps like RunKeeper. Calculations are used to compute pace. Training schedules factor in intensity, duration, and recovery periods. Running, and really any long-term commitment to physical activity, takes math and analysis.

What I like most about a little fitness gadget from Motorola called MotoActv ($249.99 for 8GB, direct) is its ability to output wonderful data. MotoActv is a touch-screen-based, GPS-enabled device and music player that correlates data beautifully. If you turn on music while working out, MotoActv can later plot your physical activity on a chart to show how your miles-per-minute ratio or strides per minute changed, by song, while running, jogging, walking, cycling, or using an elliptical machine. If you exercise outdoors and use the GPS feature, it syncs that same data to a map, which you can mouse over in a web application to see where you were geographically at different points in the graph.

Design and What's Included
Motorola's small black and red square gadget (1.75 by 1.75 by 0.25 inches?HWD) costs a small fortune?the 16GB version is $299.99. A same-capacity iPod nano?costs half that and includes an accelerometer and clock that can capture a lot of the same data, like distance and pace. When hooked into the Nike+ service and used in conjunction with compatible gym equipment, the iPod nano is very nearly the same product for much less. And it's slightly more compact and fashionable.

MotoActv's touch screen is much smaller than the plastic device itself, a little more than 1.5 inches wide by 1 inch tall.?The default screen on the bright display shows the date, time, steps taken (when working out), and number of calories you'll burn in a day, which is your baseline calorie use according to height, weight, age, and sex, plus burned calories according to exercise. Scrolling through the screens with left-right finger swipes brings up menus for settings, workouts, music, and notifications. Within each of those options, additional menus and choices appear. For example, the workouts page lets you see information about the most recent exercise activities you completed and start a new workout.

MotoActv comes with very comfortable and flexible headphones, a USB cord and outlet adapter, and not much else. Accessories sold separately that came with my kit to test the device included an arm band ($29.99) and clip ($19.99), which I can't imagine not having. If you're moving around, they are essential to using MotoActv. I also got a stiff plastic watch band ($29.99)?the official description being "sports wrist strap"?which seemed too uncomfortable to actually wear.

Set Up
Downloading the free app for my computers (both Mac and PC) was equally simple and quick. The final two pieces of the puzzle were establishing a Web account with the standard username and password requirements, and customizing my profile to account for my height, weight, age, and sex to get more accurate estimations of calories expended during physical activity.

MotoActv lets you select a few more options, though it's tough to tell what auto reminders and such you're agreeing to or dismissing based on the textual descriptions. Later, when actually working out with the device, these options become more clear, and of course you can change them after the fact.

Loading music onto the device took nothing more than connecting it to my computer with the USB cord. iTunes was recognized as my default music playing software, which made it easy to choose playlists when prompted. MotoActv is compatible with all music files types, such as MP3, AAC, and really anything that works in iTunes.?Computers recognize MotoActv as a mass storage device, which means you can also drag and drop files onto it.?The music player also includes access to FM radio.

'Bachelor' Ben Skinny-Dips Back Into Dating Pool (omg!)

'Bachelor' Ben Skinny-Dips Back Into Dating Pool

Ben Flajnik was well-prepared to be tight-lipped about Season 16 of The Bachelor, but ETonline was equally equipped to pry out some details ahead of the premiere.

Despite Ashley Hebert rejecting his proposal on last season's The Bachelorette, Ben isn't jaded on the prospect of finding love on reality TV. "I'm an opportunist and an optimist. I think you can find anyone in any way, shape, or form," he prophesied. "Doesn't matter if it's on a TV show, on an airplane, or in a restaurant."

To recover from his broken heart, Ben threw himself "back into work" and didn't date anyone "seriously." So, what was his mysterious outing with actress Jennifer Love Hewitt all about? "She reached out and wanted to come up to the winery with all her friends, which she did. We went out to dinner and chatted it off," he explained. "A nice girl, but I was right in the middle of deciding to be on The Bachelor." A self-proclaimed "down to earth person," Ben maintains that dating a celebrity is 'not something I ever imagined doing."

No telling who got the first impression rose, but Ben did comment on perhaps the most shocking introduction shown in promos. A senior citizen can be seen greeting the 28-year-old winemaker. He called her "drop dead gorgeous; a beautiful, stunning older woman." Is she a cougar or there on behalf of a granddaughter, perhaps? All Ben would say was, "She was there for a specific reason."

Now that the table's been turned, the jilted romantic better understands how Ashley simultaneously fell in love with both him and J.P. Rosenbaum, who she is currently engaged to. Ben admitted he found himself in the same predicament, falling in love with multiple women on the show. He used the virtue of "patience" to get him through his conflicting emotions.

One thing's for certain. Ben will bare his heart and his bum on the show. Laughing off an impromptu striptease with one of his pursuers, he said, "When a beautiful woman asks you to go skinny dipping, you don't say no. I think any guy would be crazy not to. A bare butt is not the end of the world."

Don't be surprised if Ben pulls a Brad Womack, a la his first stint as The Bachelor, and not drop to one knee. "I told production I'm not going on this show to propose," he asserted. "If I meet someone that strikes that chord,? I was open to it."

Ben can reveal, however, that he'll be ringing in 2012 with a pretty blonde. He'll be interviewed by bombshell Jenny McCarthy on Dick Clark's New Year's Rockin' Eve, broadcast live from New York's Times Square on ABC. Jenny appeared on Bravo's Millionaire Matchmaker as a kissing expert, so you just never know if the two will lock lips at the stroke of midnight. The Bachelor premieres January 2, 2012 on ABC.

Judge orders trial for 2 Penn St. officials (AP)

HARRISBURG, Pa. ? Lawyers for two Penn State officials charged with lying to a grand jury in the university's child sex-abuse scandal say their clients will be exonerated at trial.

District Judge William Wenner ruled Friday that prosecutors had probable cause to send the case against Tim Curley and Gary Schultz to trial.

Wenner heard testimony against Curley and Schultz on charges that they lied to a grand jury and didn't properly report an allegation that former assistant football coach Jerry Sandusky sodomized a boy in a locker room shower in 2002.

Curley's attorney, Caroline Roberto, says prosecutors "will never be able to reach their burden proof at a trial." Schultz's attorney, Tom Farrell, says his client will be acquitted.

THIS IS A BREAKING NEWS UPDATE. Check back soon for further information. AP's earlier story is below.

A Penn State assistant football coach testified Friday that he believes he saw former assistant coach Jerry Sandusky molesting a boy on campus and that he fully conveyed what he had seen to two Penn State administrators.

Mike McQueary, speaking for the first time in public about the 2002 encounter in a Penn State locker room, said he believes that Sandusky was attacking the child with his hands around the boy's waist but said he wasn't 100 percent sure it was intercourse.

McQueary took the stand Friday morning in a Pennsylvania courtroom during a preliminary hearing for university officials Tim Curley and Gary Schultz, who are accused of lying to a grand jury about what McQueary told them.

At the conclusion of the hearing, District Judge William C. Wenner ruled that prosecutors have enough evidence to send their cases to trial.

McQueary's story is central to the case against Curley and Schultz. They testified to the grand jury that McQueary never relayed the seriousness of what he saw. The officials, and Penn State coach Joe Paterno, have been criticized for never telling police about the 2002 allegation. Prosecutors say Sandusky continued to abuse boys for six more years.

The lawyers for Curley and Schultz say the men are innocent and that uncorroborated testimony from McQueary is not enough on which to hang the case. Curley and Schultz told the grand jury that they remembered McQueary reporting only something inappropriate, like wrestling, but nothing as serious as rape.

McQueary, who was on the stand for about two hours Friday, said he had stopped by a campus football locker room to drop off a pair of sneakers in the spring of 2002 when he heard slapping sounds in a shower and happened upon Sandusky and the boy.

He said Sandusky was behind the boy he estimated to be 10 or 12 years old, with his hands wrapped around the youngster's waist. He said the boy was facing a wall, with his hands on it.

McQueary, 37, said he has never described what he saw as anal rape or anal intercourse and couldn't see Sandusky's genitals, but that "it was very clear that it looked like there was intercourse going on."

In its report last month, the grand jury summarized McQueary's testimony as saying he "saw a naked boy ... with his hands up against the wall, being subjected to anal intercourse by a naked Sandusky."

Under cross examination by an attorney for Curley, McQueary reiterated that he had not seen Sandusky penetrating or fondling the boy but was nearly certain they were having intercourse because the two were standing so close and Sandusky's arms were wrapped around the youth.

He said he peeked into the shower three times ? the first via a mirror, the other two times directly. The last time he looked in, Sandusky and the boy had separated, he said. He said he didn't say anything, but "I know they saw me. They looked directly in my eye, both of them."

McQueary said the entire encounter ? from when he first entered the locker room to when he retreated to his office ? lasted about 45 seconds.

McQueary said he reported what he saw to Paterno but never went to police.

He said he did not give Paterno explicit details of what he believed he'd seen, saying he wouldn't have used terms like sodomy or anal intercourse out of respect for the longtime coach.

Paterno told the grand jury that McQueary reported seeing Sandusky doing something of a "sexual nature" with the youngster but that he didn't press for details.

"I didn't push Mike ... because he was very upset," Paterno said. "I knew Mike was upset, and I knew some kind of inappropriate action was being taken by Jerry Sandusky with a youngster."

McQueary said Paterno told him he'd "done the right thing" by reporting the encounter. The head coach appeared shocked and saddened and slumped back in his chair, McQueary said.

Paterno told McQueary he would talk to others about what he'd reported.

Nine or 10 days later, McQueary said he met with Curley and Schultz and told them he'd seen Sandusky and a boy, both naked, in the shower after hearing skin-on-skin slapping sounds.

"I told them that I saw Jerry in the showers with a young boy and that what I had seen was extremely sexual and over the lines and it was wrong," McQueary said. "I would have described that it was extremely sexual and I thought that some kind of intercourse was going on."

McQueary said he was left with the impression both men took his report seriously. When asked why he didn't go to police, he referenced Schultz's position as a vice president at the university who had overseen the campus police

"I thought I was talking to the head of the police, to be frank with you," he said. "In my mind it was like speaking to a (district attorney). It was someone who police reported to and would know what to do with it."

Curley told the grand jury that he couldn't recall his specific conversation with McQueary, but that McQueary never reported seeing anal intercourse or other sexual conduct. He said he recalled McQueary reporting wrestling or "horsing around."

Schultz said he remembered McQueary and Paterno describing what the younger coach saw only in a very general way.

"I had the impression it was inappropriate," Schultz told the grand jury. "I had the feeling it was some king of wrestling activity and maybe Jerry might have grabbed a young boys genitals."

Under cross-examination, McQueary said he considered what he saw a crime but didn't call police because "it was delicate in nature."

"I tried to use my best judgment," he said. "I was sure the act was over." He said he never tried to find the boy.

Paterno, Schultz and Curley didn't testify, but Judge Wenner read their grand jury testimony from January in weighing the case.

Sandusky says he is innocent of more than 50 charges stemming from what authorities say were sexual assaults over 12 years on 10 boys in his home, on Penn State property and elsewhere. The scandal has provoked strong criticism that Penn State officials didn't do enough to stop Sandusky, and prompted the departures of Paterno and the school's longtime president, Graham Spanier.

Curley, 57, Penn State's athletic director, was placed on leave by the university after his arrest. Schultz, 62, returned to retirement after spending about four decades at the school, most recently as senior vice president for business and finance, and treasurer.
