Florida man appeals sex asssault sentence

A Florida man who is serving up to 45 years in prison on charges he sexually assaulted a boy and a girl in the late 1990s in Fayette County wants his sentence reduced.

Judge Steve Leskinen in January sentenced Scott Alan Kelly, 40, of Orlando to 221?2-45 years in prison for sexual assault and corruption of minors.

Kelly was accused of assaulting the children in homes in Uniontown, Connellsville and Markleysburg.

A jury found Kelly guilty of corruption of minors in June. Another jury found him guilty of the assault charges during an October trial.

Through the public defender, Kelly is seeking to have the sentence reduced. In a post-sentence motion, attorney Jeffrey Whiteko contends the sentence is excessive because it is ?twice? the mandatory allowed under the law.

Whiteko contends Leskinen failed to take into consideration that Kelly had no prior record before the allegations, or after.

Leskinen set a hearing on the post-trial motion for 9:30 a.m. May 16.
